Fleet compliance audit checklist for motor carrier records: sources and guidance

A periodic records audit for a US interstate motor carrier: driver qualification files, controlled substances and alcohol testing records, hours of service records, and vehicle inspection, repair and maintenance files. Each motor carrier keeps a qualification file for each driver it employs [65] and systematically inspects, repairs and maintains the vehicles under its control [119].

How often: How often you run the full audit is set by your organization. Several records it checks have their own 12-month deadlines: the annual driving record review, the annual Clearinghouse query and each vehicle's periodic inspection.[59][30][106]

Purpose

Use this fleet compliance audit checklist to review a US interstate motor carrier's own compliance records on a regular cycle: driver qualification files, the controlled substances and alcohol testing program, hours of service records, and vehicle inspection, repair and maintenance files. It is a records audit, not a vehicle inspection. It checks that the files the Federal Motor Carrier Safety Regulations call for exist, are complete and are kept for the right period, so that gaps are found and fixed by the carrier first.

The rules apply to employers, employees and commercial motor vehicles that transport property or passengers in interstate commerce [45]. A commercial motor vehicle is a self-propelled or towed motor vehicle used on a highway in interstate commerce to transport passengers or property [46] that meets one of the definition's tests, for example a weight rating or weight of 10,001 pounds or more [47]. The first section of the checklist records which tests the carrier's vehicles meet.

Who should use it

Fleet safety managers and compliance staff who look after driver files, drug and alcohol testing, logs and maintenance records. A small carrier or owner-operator can use it as a self-audit, and a consultant can use it to audit a client carrier. Where a service agent, such as a consortium or third-party administrator, holds testing records for the carrier, ask for those records and audit them the same way.

How often

How often you run the full audit is set by your organization. Several records it checks have their own deadlines: the motor vehicle record inquiry and review for each driver at least once every 12 months [58] [59], a Clearinghouse query for each driver at least once per year [30], and a periodic inspection of each vehicle at least once during the preceding 12 months [106]. Audit often enough that none of these can lapse between audits.

How to use this checklist

  1. Record the carrier, the audit date and the records you sampled. Include new hires, long-serving drivers and drivers who left during the last three years.
  2. Answer the applicability questions first. If the carrier does not operate commercial motor vehicles in interstate commerce, its state's rules apply instead and this checklist may not fit.
  3. Add one driver file entry for each driver and one vehicle file entry for each vehicle in your sample. Mark N/A only where the help text says so.
  4. Review the testing program records and a sample of records of duty status with their supporting documents.
  5. Write each finding with the record it relates to, assign a corrective action, and sign.

Six checks are marked critical because the rule itself stops a driver or vehicle until the record is right. A person must not operate a commercial motor vehicle without being medically qualified [63]. A driver must not perform safety-sensitive functions before the carrier receives a verified negative pre-employment drug test result [1] or runs a pre-employment Clearinghouse query [28], or while Clearinghouse results show a violation that has not been resolved [32]. A carrier must not use a commercial motor vehicle [107] without a periodic inspection in the preceding 12 months [106]. A defect on a driver vehicle inspection report that is likely to affect safety is repaired [102] before a driver is required or permitted to operate the vehicle [103]. Your organization may treat other findings as urgent too.

What the rules say

  • Driver qualification files. Each motor carrier keeps a file for each driver it employs [65]. It holds the application for employment [66], the pre-hire motor vehicle records [67], the road test certificate [68] or an accepted equivalent [69], and the medical examiner's certificate [70]. The file is kept while the driver is employed and for three years after [74].
  • Annual driving record review. At least once every 12 months the carrier obtains each driver's motor vehicle record [58] and reviews it [59], and files a note with the reviewer's name [61] and the review date [62].
  • Testing program. Records are kept in a secure location with controlled access [13]. Random selection uses a scientifically valid method [7], and random tests are unannounced [11]. Each driver signs a statement that they received the carrier's educational materials [24].
  • Clearinghouse. The carrier runs a pre-employment query before a driver performs a safety-sensitive function [28], a query for every driver at least once per year [30], and keeps a record of each query for 3 years [34].
  • Hours of service. Drivers record their duty status on an ELD [92] unless an exception allows paper records [93]. The carrier keeps records of duty status and supporting documents [100] for at least 6 months from receipt [101].
  • Inspection, repair and maintenance. The carrier systematically inspects, repairs and maintains the vehicles under its control [119], records each job with its date and nature [122], keeps those records for 1 year and for 6 months after a vehicle leaves its control [123], and keeps each annual inspection report for 14 months [116].

What this checklist does not cover

  • Carriers operating only in intrastate commerce. States set rules for those operations; check your state's motor carrier rules.
  • Hazardous materials transportation rules, hazardous materials safety permits and hazmat employee training records.
  • Rules specific to passenger carriers, including the hours of service limits for passenger-carrying vehicles.
  • Driver qualification exceptions in 49 CFR Part 391, subpart G, and the hours of service exceptions in 49 CFR 395.1, including the short-haul exceptions.
  • The vehicle inspections themselves. Use the driver vehicle inspection, DOT annual inspection and CDL pre-trip inspection checklists for those.
  • Post-accident, reasonable suspicion, return-to-duty and follow-up testing decisions, and the testing procedures in 49 CFR Part 40.
  • CDL licensing, entry-level driver training and the CDL skills test.
  • Operating authority, insurance filings, and state registration, fuel tax and permit records.
  • Safety ratings, compliance reviews and FMCSA investigations. This checklist does not predict the outcome of any enforcement action.

Questions

What records does a fleet compliance audit cover?

This checklist covers the driver qualification file for each driver [65], the controlled substances and alcohol testing program records [13], records of duty status and supporting documents [100], and each vehicle's inspection, repair and maintenance records [122]. It also checks the accident register, which is kept for 3 years after the date of each accident [36].

How long must a motor carrier keep driver qualification files?

For as long as the driver is employed and for three years after [74]. Safety performance histories from previous employers for a hired driver are kept in the driver investigation history file for the same period [77].

How long must drug and alcohol testing records be kept?

At least five years for alcohol results of 0.02 or greater, verified positive drug results and refusals [15] [16] [17]. At least one year for negative and canceled drug results [19] and alcohol results below 0.02 [18]. FMCSA can ask to see the records at the carrier's principal place of business within two business days [22].

How long do we keep driver logs and supporting documents?

At least 6 months from the date the carrier receives them [100] [101]. Drivers submit each record of duty status within 13 days [97], and supporting documents are kept so that they can be matched to the driver's record of duty status [84].

What maintenance records does each vehicle need?

An identification of the vehicle [120], a way to show the nature and due date of inspection and maintenance tasks [121], and a record of inspections, repairs and maintenance with their dates [122]. Driver vehicle inspection reports are kept for three months [105], and the annual inspection report for 14 months [116] where the vehicle is housed or maintained [117].

Does this audit apply to carriers that only operate within one state?

The federal rules apply to transport in interstate commerce [45]. That includes transport between a place in one state and a place outside it [51], and between two places in one state when the trip is part of a movement that starts or ends outside the state [52]. Carriers that operate only within one state follow their state's rules, which this checklist does not cover.
