Waste management audit checklist: sources and guidance

A site audit of hazardous waste management under the federal RCRA generator rules in 40 CFR Part 262, with universal waste checks from Part 273. It starts from the generator category your organization has already determined each month [12] and checks containers, labels, inspections, emergency readiness and shipping records against the conditions for that category.

How often: Audit frequency is set by your organization. Small and large quantity generators inspect their central accumulation areas at least weekly.[33][50]

Purpose

Use this waste management audit checklist to walk a US site's hazardous waste areas and records and write down what you find. It follows the federal hazardous waste generator rules under the Resource Conservation and Recovery Act (RCRA) in 40 CFR Part 262, and the universal waste rules in Part 273 for batteries and lamps. Each check names the condition from the rule text, so a failed answer points to something specific to fix.

The checklist does not classify waste. Whether a waste is hazardous is decided by the generator at the point of generation [8], and the generator works out its own category each calendar month [12]. Enter the category from your records. Checks that apply to only some categories say so in their label or help, and you mark the rest N/A; the form does not hide them for you.

Who should use it

Environmental, health and safety staff, site managers and waste coordinators who look after hazardous waste areas, and internal auditors checking a site before a regulator does. It suits one person walking the site with the records at hand.

How often

Your organization sets how often to run the full audit. The rules do set one frequency: small and large quantity generators inspect their central accumulation areas at least weekly [33] [50]. This audit does not replace that weekly inspection; keep the weekly log separately and review it here.

How to use this checklist

  1. Before you start, get the site's current generator category, its waste determination records, the last year of manifests and the weekly inspection log.
  2. Enter the generator category. Checks that apply only to some categories say so in the label or help; mark the others N/A. Very small quantity generators are not bound by most of the conditions in 40 CFR Part 262 [13], so many checks will be N/A for them.
  3. Walk each satellite accumulation area, then the central accumulation area, and look at every container, not a sample.
  4. Check the emergency equipment and postings where waste is generated and stored.
  5. Review training records, manifests and signed return copies.
  6. Record each failed check in the findings with its location, a person responsible and a due date.

No item on this page is marked critical. The checks record storage, labeling and paperwork conditions to correct, not conditions that stop work by themselves; move waste from a leaking container straight away.

What the rules say

  • Determinations and category. The hazardous waste determination is made at the point of generation [8]. Small and large quantity generators keep records supporting their determinations [9] for at least three years from the date the waste was last sent to on-site or off-site treatment, storage or disposal [10].
  • Satellite accumulation. A generator may keep up to 55 gallons of non-acute hazardous waste, or one quart of liquid acute hazardous waste, in containers at or near the point of generation [17] [18]. Containers are closed except when waste is added, removed or consolidated [23] [24] and are marked "Hazardous Waste" with an indication of the hazards [25] [26].
  • Central accumulation. Small quantity generators may accumulate for no more than 180 days [30] and large quantity generators for no more than 90 days [48], in the cases the rules describe. Each container shows the date accumulation began [38] [56].
  • Shipping. Off-site shipments travel on a manifest [61] that names a permitted designated facility [63], and the signed return copy is kept for at least three years [64].
  • Universal waste. Batteries and lamps are labeled with one of the listed phrases [73] [74] and kept no longer than one year [75].
  • State programs. EPA approves state hazardous waste programs [67], and nothing in the federal rules stops a state from adopting requirements that are more stringent or more extensive [68] [69]. Check your state's rules alongside this checklist.

What this checklist does not cover

  • Deciding whether a waste is hazardous or which generator category applies. Those determinations are your organization's own.
  • State hazardous waste rules. States with EPA-approved programs can be stricter or broader than the federal rules, so check your state agency's rules as well.
  • Tank systems, drip pads and containment buildings, which have their own conditions in 40 CFR 262.16 and 262.17.
  • The full preparedness, prevention and contingency plan rules for large quantity generators in 40 CFR Part 262 subpart M.
  • Episodic generation, academic laboratories, hazardous waste pharmaceuticals, used oil and large quantity handlers of universal waste.
  • Department of Transportation packaging, marking and placarding, and land disposal restriction paperwork.
  • Biennial reports, the contents of exception reports, re-notification and closure notices.

Questions

What are the hazardous waste generator categories?

They depend on how much hazardous waste a site generates in a calendar month. A very small quantity generator generates no more than 100 kg (220 lb) of non-acute hazardous waste [6] [7]; a small quantity generator more than 100 kg but less than 1,000 kg (2,200 lb) [5]; and a large quantity generator 1,000 kg or more [1]. Generating more than 1 kg (2.2 lb) of acute hazardous waste in a month also makes a site a large quantity generator [2], as does generating more than 100 kg (220 lb) of residue, soil, water or other debris from cleaning up a spill of acute hazardous waste [3] [4]. Your organization makes this determination; the checklist does not.

How often must a hazardous waste storage area be inspected?

Small and large quantity generators inspect central accumulation areas at least weekly, looking for leaking containers and for deterioration caused by corrosion or other factors [50] [51] [33].

What must a hazardous waste container label say?

In satellite and central accumulation areas, containers are marked with the words "Hazardous Waste" and an indication of the hazards of the contents [25] [26]. In a central accumulation area the date accumulation began must also be clearly visible on each container [56]. Before shipping, containers are also marked with the applicable EPA hazardous waste codes [11].

How long do we keep manifests?

Keep the copy signed by the receiving facility for at least three years from the date the initial transporter accepted the waste [64]. If a large quantity generator has no signed copy within 45 days, it contacts the transporter or the facility [65]; a small quantity generator acts at 60 days [66].

Do very small quantity generators need to do anything?

Yes. They still make hazardous waste determinations [14], and they send waste only for on-site treatment or disposal or to the kinds of facilities the rule lists [16]. Extra conditions apply once they accumulate 1,000 kg (2,200 lb) or more of non-acute hazardous waste [15].

Are the federal rules the only ones that apply?

Not always. States can run EPA-approved programs [67] with requirements more stringent or more extensive than the federal rules [69]. Where your state has its own program, its rules apply as well.
